£20,750 compensation for a part-time groom that sustained a kick injury at work

We recently acted for Ms R following an accident in her place of work.

The circumstances of the accident were that Ms R, aged 16 at the time of the accident, was working her weekend job at a riding school yard when she was asked to turn out one of the horses.

Unbeknown to Ms R, the horse that she had been asked to turn out had a history of temperament issues. On attempting to turn the horse out he spun around and ‘double barrel’ kicked her in the face, breaking her jaw in two places and causing her to briefly lose consciousness.

A letter of claim was sent to the third party insurer alleging fault on the basis that it’s insured had failed to warn Ms R of the horse’s known characteristics and failed to take positive steps to safeguard her health, safety and wellbeing whilst at work. An early admission of liability was obtained.

The medical experts instructed by HorseSolicitor documented that Ms R made a good functional recovery from her injuries, though she was likely to suffer from altered sensation and mild paraesthesia of her lip indefinitely, in addition to suffering from mild permanent swelling of the left side of her jaw.

Following Ms R’s physical and psychological recovery an out of court settlement was agreed in the sum of £20,750.
