Soft Tissue Injury Claims

Soft tissue injuries are injuries to muscles, tendons, ligaments or cartilage. People often underestimate the impact a soft tissue injury can have.  Because of the name, people do not realise that they can be just as debilitating as broken bones.

At HorseSolicitor we know that having a specialist equine accident solicitor who knows how to get the most out of your claim can dramatically increase the amount of compensation you get.

FAQ's

How serious is it?

They can be as serious as broken bones and sometimes more so.  There are often incorrectly diagnosed, and as a result, claimants can end up under-settling their claims.

Many riders suffer from shoulder injuries when they’re thrown from their horses and what looks like a simple “soft tissue” injury can turn end up in permanent injury, with shoulder injuries being one of the most common.

If you don’t want to under settle your claim, then it’s important to instruct a horse accident solicitor who understands the mechanics of a horse riding accident.

It’s also important that you do it right the first time.  If you under-settle your claim, having failed to fully investigate it, you are not entitled to reopen it at a later date.

What is Complex regional pain syndrome (“CRPS”)?

CRPS is a disorder where an injured person can suffer pain, of a severity and duration, grossly disproportional to the initial injury, which is often relatively minor.  The softest touch to a person’s skin can cause excruciating pain.   The affected area can change temperature, colour, become stiff, and swollen.

Whilst typically confined to an affected limb, occasionally CRPS can spread and its effects can be very incapacitating.

CRPS cases often misunderstood by solicitors and the most vigorously disputed by defendants. While CRPS claims can be very large in monetary terms, they are often missed entirely. Nowhere is it more vital to have a knowledgeable, solicitor experienced in CRPS claims.

What help is available?

Rehabilitation can be very effective when you’ve suffered a soft tissue injury and it tends to come in the form of physiotherapy.

The NHS do a wonderful job but unfortunately its well documented financial constraints mean that it doesn’t always have the resources to offer the intensive rehabilitation to generate the best possible outcome.

As part of your successful claim we can arrange for you to have the private treatment that you need.

Who will pay for it?

The other side’s insurance company can typically be made to pay for it under the Rehabilitation Code.  Even if your claim is not successful you wouldn’t have to repay the costs they’ve spent on your rehabilitation.

How much can I claim for a soft tissue injury?

It can be a lot, it all depends on the type of the injury that you have sustained.  When awarding damages for an injury, the court is less worried about the type of the injury than the impact it’s had on you. The court will consider how much pain is caused by the injury, what it stops you from doing, and the duration of your recovery.

If you’ve suffered a soft tissue injury, have a look on our personal injury calculator to see how much we could recover on your behalf.

What about my financial losses?

In addition to the compensation you will receive for your injuries, your horse accident claim should include anything and everything the accident has cost you financially.

This goes for losses you’ve already had, like time off work, increased livery bills, insurance excess, and out of pocket expense, as well as losses you might suffer in the future.  If you need more rehabilitation in the future, we will claim the cost of it.

We can also take you through some of the losses that you may not be aware of such as where someone has had to provide help for you or your horse as a result of a horse related accident you can claim an hourly rate for the time they spent doing it.
