HorseSolicitor wins untraced horse riding accident claim
The circumstances of the accident were that our client was hacking out on her horse, accompanied by her stepson, who was on another horse. A motorbike came up alongside her, far too close, and the motorcyclist revved the engine. The horse bolted and the motorcyclist continued to rev the engine, this caused the horse to rear and for our client to fall. She sustained a fractured humerus, a sprained neck, sprained thumbs and a phobia of hacking out. The motorcyclist failed to stop and remained untraced.
HorseSolicitor recommended a claim against an organisation called the Motor Insurers’ Bureau (MIB) which exists to compensate victims of negligent untraced drivers (and uninsured drivers). The claim was successful.
We hope that this case raises awareness of a riders right to claim compensation even in cases where the driver fails to stop and cannot be traced.
A vehicle does not have to have made contact with you or your horse for the driver to be held responsible for the accident. It’s just as negligent to spook a horse by driving past too close or too quickly as it is to crash into them.
The Motor Insurers’ Bureau (MIB) is an organisation which exists to compensate people that have been injured by negligent drivers, who are either untraced or uninsured. A small portion of the money paid for all car and motorbike insurance policies goes to the MIB who act as an insurer of last resort.
