Recent changes to the way that personal injury claims are funded and the impact on Defendants

Changes to the way that personal injury claims are funded, implemented by the government in April 2013, mean that even when a Defendant successfully defeats a claim there are very limited circumstances in which the Court will allow the Defendant to recover their legal fees incurred in defending that claim.

In most cases no defence costs are recoverable.

Unless the Defendant has sufficient insurance to indemnify them against these costs they may find themselves in the position of having to consider paying for a lawyer to defend a claim brought against them and having to meet these fees even if the claim against them is unsuccessful. It is not uncommon for defence costs to a contested trial to run in to the tens of thousands of pounds.
